1. About Blue Loop

Blue Loop ("we", "us", "our") is a Kenya Coast travel and listings platform operated by Velora Systems, Watamu, Kilifi County, Kenya. Our platform at blueloop.co.ke connects travellers with local hosts, operators, and experience providers across the Kenya Coast. By accessing or using Blue Loop, you agree to these Terms of Use in full. If you do not agree, please do not use the platform.

2. Who Can Use Blue Loop

Blue Loop is open to anyone aged 18 years or older. By using the platform, you confirm that the information you provide is accurate and that you have the legal capacity to enter into agreements. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. What Blue Loop Does

Blue Loop is a marketplace and directory — we connect travellers with independent hosts and experience operators. We do not own, manage, or operate any of the properties or activities listed on the platform. Blue Loop facilitates introductions and enquiries; the contract for any stay or experience is directly between the traveller and the host or operator.

4. Listings & Accuracy

Hosts and operators are solely responsible for the accuracy, completeness, and legality of their listings, including descriptions, photos, pricing, availability, and any applicable licences or permits. Blue Loop reviews listings before publishing but cannot guarantee the accuracy of all information. We encourage travellers to conduct their own due diligence before booking.

5. Bookings & Payments

Booking enquiries submitted through Blue Loop are directed to the relevant host or operator for confirmation. Payment terms, methods (including M-Pesa, card, or bank transfer), and schedules are agreed directly between traveller and host. Blue Loop may facilitate payments for certain bookings — where we do, applicable payment terms will be presented at checkout. Blue Loop charges a service fee on facilitated transactions, which will be disclosed clearly before payment.

6. Cancellations & Refunds

Cancellation and refund policies are set individually by each host or operator and are stated on the relevant listing page. Blue Loop is not liable for any losses arising from cancellations, changes, or no-shows. Where Blue Loop has facilitated payment, any refund will be processed in accordance with the host's stated policy. If you require assistance with a dispute, contact us at info@blueloop.co.ke and we will endeavour to mediate in good faith.

7. User Conduct

You agree not to use Blue Loop to: post false, misleading, or fraudulent listings or reviews; infringe the intellectual property rights of others; transmit spam, malware, or harmful code; scrape, copy, or reproduce any part of the platform without our written permission; engage in any activity that disrupts or damages the platform or its users; or attempt to circumvent our platform to transact directly with hosts in a way that deprives Blue Loop of its legitimate service fees.

8. Reviews & User Content

Users may submit reviews, photos, and other content ("User Content") to Blue Loop. By submitting User Content, you grant Blue Loop a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content on the platform and in our marketing materials. You confirm that your User Content is your own, is accurate, and does not violate any third-party rights. Blue Loop reserves the right to remove any User Content that violates these Terms or our community standards.

9. Intellectual Property

All content on Blue Loop — including the Blue Loop name, logo, design, copy, photography, and software — is the property of Velora Systems or its licensors and is protected by Kenyan and international intellectual property law. You may not reproduce, distribute, or create derivative works from any Blue Loop content without our express written consent.

10. Disclaimers & Limitation of Liability

Blue Loop is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access to the platform, nor that listings will meet your expectations. To the fullest extent permitted by Kenyan law, Blue Loop and Velora Systems shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform, including losses relating to bookings, cancellations, personal injury, or property damage occurring during a stay or activity listed on Blue Loop.

11. Third-Party Links & Services

Blue Loop may contain links to third-party websites or integrate with third-party services (such as payment processors or map providers). We are not responsible for the content, privacy practices, or reliability of those services. Use of third-party services is at your own risk and subject to their own terms and conditions.

12. Governing Law & Disputes

These Terms are governed by the laws of Kenya. Any disputes arising from your use of Blue Loop shall be subject to the exclusive jurisdiction of the courts of Kenya. We encourage users to contact us directly in the first instance to resolve any issues informally before pursuing formal proceedings.
